Dippolito Released From Jail During Appeal

PALM BEACH (CBS4) – Sentenced to 20 years in prison for attempting to hire a hitman to kill her husband, Dalia Dippolito has been released from the Palm Beach County jail.

Last month, Palm Beach County Judge Jeffrey Colbath ordered that the 28-year old could be released on a half million dollars bond as she appealed her conviction and sentence.  On Tuesday she was driven to her mother's home in Boynton Beach where she will be under house arrest during the appeals process, according to The Palm Beach Post.

Dippolito's attorney said his client did not receive a fair trial because one of their key witnesses who said he was going to be out of the country during the trial was not and failed to testify.

In May, a jury convicted Dippolito of plotting to kill her husband Michael in August 2009. She was caught on a police surveillance tape telling the hit man, who was really an undercover Boynton Beach police officer, that she was sure she wanted Michael Dippolito dead. She offered the hitman $3,000 to do the job.

Dippolito's defense was that she was acting for a reality TV show.  Michael Dippolito denied that claim.

According to court records, Dippolito had tried twice before tried to kill her husband. One time, she allegedly tried to hire a Riviera Beach man to kill her husband but he later reneged. She also allegedly spiked her husband's drink with odorless anti-freeze. He reportedly spit out the drink after commenting that it tasted like gasoline.
